Welcome to the mobile application operated by RallyIQ Technology Inc. ("we", "us", or "our"). This Privacy Policy describes how we collect, use, and share information about you when you use our mobile application distributed by 1485814 B.C. Ltd.

Information We Collect and Your Consent

By using our App, you expressly consent to our collection, use, sale, and processing of personal data including, but not limited to, your name, email address, photographs, videos, biometric data derived from images, and other media content you upload or create using the App ("User Content"). We may also collect information about your device, usage patterns, location data, and any other information you provide.

YOU EXPRESSLY CONSENT TO OUR SALE, LICENSE, OR OTHER TRANSFER OF YOUR PERSONAL DATA AND USER CONTENT TO THIRD PARTIES FOR THEIR COMMERCIAL USE, including but not limited to marketing, advertising, research, AI model training, product development, and any other lawful business purposes. You represent and warrant that you have all necessary rights, licenses, and permissions to provide any User Content to us and to authorize us to sell or transfer such User Content to third parties, and that such User Content does not violate any third-party rights or applicable laws.

Use of AI Providers, Data Sharing, and Data Sales

Our App utilizes AI technologies provided by third-party providers, including but not limited to OpenAI and other machine learning service providers, to analyze, process, and enhance User Content. Additionally, we may sell, license, transfer, or otherwise share your User Content and personal data with third-party companies, advertisers, data brokers, research organizations, and other business partners for their own commercial purposes.

By using the App, you expressly authorize us to share, sell, or transfer your User Content and personal data with any third parties for purposes including analysis, processing, model training, service improvement, marketing, advertising, research, product development, and any other lawful business purposes. These third parties may retain, use, sell, and further distribute your data and anonymized or aggregated data derived from your User Content.

While we use commercially reasonable efforts to work with reputable providers, we cannot guarantee the security, confidentiality, or use of data processed, purchased, or obtained by third parties, and you assume all risks associated with such processing, sharing, and sales. We are not responsible for the privacy practices or data handling of any third party that receives your data.

International Data Transfer

Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. We ensure that your data is treated securely and in accordance with this Privacy Policy.

Use by Minors

Data Retention

We retain personal data and User Content for as long as we determine is necessary for business purposes, including to fulfill the purposes for which it was collected, to improve our AI models and services, for research and development, and to comply with any legal, accounting, or reporting requirements. We may retain anonymized or aggregated data indefinitely. Even after you delete content or close your account, we may retain copies in our backup systems and continue to use anonymized versions of your data.

Compliance, Disclaimers, and Limitation of Liability

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and all applicable Apple App Store requirements to ensure the protection of your personal data.

HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT:

  • AI analysis is not perfect and may produce inaccurate, incomplete, or inappropriate results;
  • We are not responsible for any decisions you make based on AI-generated outputs;
  • You use the App and its AI features at your own risk;
  • We are not responsible for how third parties use, store, or protect data we sell or share with them;
  • To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding the accuracy, reliability, security of our services, or the practices of third parties who receive your data; and
  • In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, any unauthorized access to or use of your personal data, or any third-party use of data we have shared or sold, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims shall not exceed the amount you paid to us in the past twelve months, or $100, whichever is less.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We encourage you to review this Privacy Policy periodically for any changes.

Indemnification and Contact

You agree to indemnify, defend, and hold harmless RallyIQ Technology Inc., its officers, directors, employees, agents, affiliates, and any third parties who purchase or receive data from us, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) any User Content you provide; (c) your violation of this Privacy Policy; (d) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; (e) any claim that your User Content caused damage to a third party; or (f) any third-party use of your data that we have sold, shared, or transferred.

BY DOWNLOADING, ACCESSING, OR USING OUR APP, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY, INCLUDING ALL DATA COLLECTION, USE, SHARING, AND LIABILITY LIMITATION PROVISIONS CONTAINED HEREIN.
