Age Gating

The app is developed by RallyIQ Technology Inc. and distributed by Excello. Excello, as the distributor, implements age verification processes to ensure compliance with the Children's Online Privacy Protection Act (COPPA), Apple's App Store Review Guidelines (sections 1.3 and 5.1.4), and applicable state laws. Children age 13 and under must obtain verifiable parental consent prior to accessing the app.

Excello utilizes Apple's Declared Age Range API to receive age category information and parental consent status for users in applicable jurisdictions. RallyIQ Technology Inc. is responsible for app functionality, content, and in-app features, while Excello is responsible for distribution and age verification compliance.

Parental Consent

Parents or legal guardians must provide verifiable consent for children age 13 and under to use the app, in compliance with COPPA requirements. Consent may be obtained through Apple's parental consent mechanisms integrated into the App Store.

Parents will be clearly informed about what personal information is collected from their child, how it is used, whether it is disclosed to third parties, and the parent's rights regarding their child's information.

• Neither Excello nor RallyIQ Technology Inc. collects precise geolocation data, photographs, videos, audio recordings, or contacts from children without additional explicit parental consent for each specific data type.
• Excello does not share any personally identifiable information or device information collected from children with third parties without explicit parental consent.
• Parents may revoke consent at any time, which will result in the deletion of the child's personal information and termination of the child's access to the app within thirty (30) days of the revocation request.

Parental Visibility and Controls

Parents and legal guardians are granted access to review, modify, and delete their children's personal information within the app. Parents can monitor their child's activities, review data collected, and manage privacy settings through the parental control interface.

• Parents may request a description of the types of personal information collected from their child and may refuse to permit further collection or use of their child's information.
• All parental control features are accessible through clearly marked sections within the app, behind appropriate parental gates.

Right to Suspend Accounts

Excello retains the right to suspend or terminate any user account that is found to be in violation of the app's Terms of Service, Apple's App Store Review Guidelines, or if fraudulent information (including false age declarations) is discovered. This measure is in place to protect the integrity of the app, ensure the safety of all users, and maintain compliance with COPPA, applicable state laws, and Apple's requirements.
